Actress Kelly Rutherford’s children must be returned to US, judge says.

On Friday a California judge granted the Gossip Girl star custody of eight-year-old son Hermes and six-year-old daughter Helena, who have been living in France and Monaco with their father Daniel Giersch since 2012.It comes after much campaigning which saw the likes of Kim and Kelly’s Gossip Girl co-stars Ed Westwick and Chace Crawford coming forward in support of her winning her children back by urging their fans to sign a petition which, if it reached 100,000 signatures, would be reviewed by policy-makers at the White House.

The kids will soon return to Los Angeles to be with their mother during the custody battle proceedings, provided the Monaco courts honour the California ruling. “We are ecstatic, and hopeful that Monaco will respect the California court’s ruling and send the children home,” Rutherford’s lawyer Wendy Murphy told People. “It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country.” Initially the couple shared joint custody of the children but when Giersch’s US visa was revoked in 2012 he returned to Europe. The expense of the ongoing legal battles caused the actress to file for bankruptcy. “What we don’t understand is why they had to be sent to a foreign country,” Murphy told Fox News in April. “It’s an unprecedented cause and we’re not giving up…we will never give up.”
