‘Gossip Girl’ mom granted temporary sole custody of two children.

(CNN) — Actress Kelly Rutherford, who played Lily van der Woodsen on Gossip Girl, has been granted temporary sole custody of her two children in a protracted dispute that sparked an online petition.It comes after much campaigning which saw the likes of Kim and Kelly’s Gossip Girl co-stars Ed Westwick and Chace Crawford coming forward in support of her winning her children back by urging their fans to sign a petition which, if it reached 100,000 signatures, would be reviewed by policy-makers at the White House.According to People, a California judge ruled Friday that the Gossip Girl star’s children, Hermes, 8,and Helena, 5, must be brought back to the U.S. from Monaco. “We are ecstatic, and hopeful, that Monaco will respect the California court’s ruling and send the children home,” Rutherford’s lawyer Wendy Murphy told People. “It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country.” Since Giersch was denied re-entry to the U.S. after traveling abroad, Rutherford had to travel to Europe to see her children.

The expense of the ongoing legal battles caused the actress to file for bankruptcy. “What we don’t understand is why they had to be sent to a foreign country,” Murphy told Fox News in April. “It’s an unprecedented cause and we’re not giving up…we will never give up.” Giersch, after reviewing the Orders, will cooperate fully and assist us in peacefully transferring the children to Kelly’s custody.” He claimed she was refusing to turn over the children’s passports. Rutherford argued that she was willing to have a mutually agreed party hold them but did not want to turn the documents over to a designee of Giersch’s choice.
