(CNN) — Actress Kelly Rutherford, who played Lily van der Woodsen on Gossip Girl, has been granted temporary sole custody of her two children in a protracted dispute that sparked an online petition.On Friday a California judge granted the Gossip Girl star custody of eight-year-old son Hermes and six-year-old daughter Helena, who have been living in France and Monaco with their father Daniel Giersch since 2012. The kids will soon return to Los Angeles to be with their mother during the custody battle proceedings, provided the Monaco courts honour the California ruling. “We are ecstatic, and hopeful that Monaco will respect the California court’s ruling and send the children home,” Rutherford’s lawyer Wendy Murphy told People. “It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country.” Initially the couple shared joint custody of the children but when Giersch’s US visa was revoked in 2012 he returned to Europe.

Giersch, after reviewing the Orders, will cooperate fully and assist us in peacefully transferring the children to Kelly’s custody.” He claimed she was refusing to turn over the children’s passports. Rutherford argued that she was willing to have a mutually agreed party hold them but did not want to turn the documents over to a designee of Giersch’s choice.
