Amber Heard, the actress and wife of Johnny Depp, has been charged with illegally bringing the couple’s dogs into Australia and could face up to 10 years in prison, prosecutors said Thursday.Johnny Depp’s actress wife Amber Heard has been summoned to appear in the Southport Magistrates Court in Queensland over the allegations of smuggling her two Yorkshire terriers in Australia. Heard and Depp brought their Yorkshire terriers, Pistol and Boo, on their private plane to Australia, where Depp was filming the fifth “Pirates of the Carribean” movie, in May.

The nation’s agriculture minister, Barnaby Joyce, told the couple to take the pooches home or see them euthanized because of the country’s strict quarantine regulations with pets. The false document charge, which relates to information on an incoming passenger card, carries a penalty of up to one year in prison and a fine of AU$10 200.

A Department of Agriculture officer later escorted the tiny terriers from the couple’s mansion on Queensland’s Gold Coast to the airport, where the dogs boarded a flight to the U.S. just hours before the deadline. “The law is the same for everybody,” he told reporters in the western city of Perth. “There is no preferential treatment here. You come into our nation, you have to abide biosecurity protocols.” The prosecutor’s office would not answer questions about why Depp wasn’t charged, citing the ongoing nature of the case. And I’m sure the court will take all of those things into account.” In an interview last month, Heard said she and Depp planned to avoid Australia as much as possible in the future “thanks to certain politicians there.”
